Goole businessman prosecuted for using public highway and car park to sell cars

A businessman from Goole has been prosecuted for breaching a Community Protection Notice which banned him from advertising cars for sale on a public highway and in a town car park.

Anthony Heppenstall of Estcourt Car Sales, Estcourt Street, was ordered to pay a total of £1,920.67 after he was found to have breached the CPN, served on him in 2020, by displaying more cars for sale on the road and in Estcourt Street car park in Goole.

Heppenstall did not attend Beverley Magistrates’ Court on 30th April, when the case was heard, and he was found guilty in his absence for failing to comply with the notice.

He was fined £1,100 and was ordered to pay £380.67 costs and a £440 victim surcharge.

The court heard Heppenstall was originally served with the CPN – Section 43 of the Anti-social Behaviour, Crime and Policing Act 2014 – by East Riding of Yorkshire Council in 2020 to prevent him from using the car park and public highway to display cars he was selling.

But in August 2024, the council received complaints that it was happening again. Officers from the council’s streetscene enforcement team investigated and found eight vehicles for sale by Estcourt Car Sales in Estcourt Street car park and on the road in September 2024.

Heppenstall was sent a £75 fixed penalty notice for breaching the order, but he failed to pay, so the matter was taken to court.

Carl Skelton, director of streetscene services at East Riding of Yorkshire Council, said: “The public highway and car parks cannot be used for business purposes, this is illegal, and like in this case, action will be taken against anyone found doing so.”
